Reasons NOT to delay your personal injury claim

There are several reasons why you should not delay your personal injury claim. Below we have outlined why it is best to act fast after an incident has taken place.


With time it is likely that your recollection of the accident circumstances will grow less and less accurate. This is particularly true as the weeks turn into months after your accident. Even if the accident has had a profound impact on your life, over time small relevant points may be forgotten. For this reason, it is best to make a claim when the facts are still at the forefront of your mind.


As time goes by, all important witnesses to the incident will be harder to trace since there is the possibility that potentially vital witnesses could move or change phone numbers.


CCTV footage that may be available could be recorded over if you do not act quick enough and as CCTV footage is usually only held for around 28 days, you may lose crucial evidence. If CCTV footage is available, and you act sooner, your solicitor can take steps to ensure that footage is preserved.


If your claim is against your employer or a business, make sure you make a claim before they cease trading or are subject to insolvency procedures as it would be difficult to claim compensation if they are no longer operating. 


If you are claiming for a personal injury caused by a slip or trip, the defect that caused your accident may be fixed or removed before you have a chance to claim. This will make it difficult to assess the hazardous nature of the defect. To help your case it is important to take pictures and videos at the time the incident had occurred. 


Of course, even with the best intentions it is not always possible to act fast. If you do decide to wait before claiming it is important that you wait no more than three years. The time period of three years is important as it is the deadline to make a claim in most personal injury claims (although there are exceptions) after which, the claim is “time-barred”.
